This Privacy Policy describes how Realsy, LLC (“Realsy,” “we,” “us,” or “our”) collects, uses, and shares information when you visit realsy.com (the “Site”), create an account, purchase a valuation report (a “Report”), or otherwise use our services (collectively, the “Services”).
By using the Services, you agree to the collection and use of information as described in this Privacy Policy.
1. Information We Collect
1.1 Information You Provide Directly
- Account and signup information: name, email address, market or geographic area, brokerage or company affiliation, and approximate transaction volume (such as listings per year), and any other information you provide when joining our mailing list or creating an account.
- Property information: addresses and characteristics of properties you submit to generate Reports, which may include details about condition, improvements, and features.
- Payment information: payments are processed by our payment processor, Stripe. Realsy receives transaction confirmations and limited billing details (such as name, billing address, and the last four digits of a card) but does not collect or store full payment card numbers. Stripe's handling of your payment information is governed by Stripe's privacy policy.
- Communications: information you provide when you contact support, respond to surveys, or otherwise communicate with us.
1.2 Information Collected Automatically
When you use the Site or Services, we and our service providers may automatically collect:
- Usage data: pages viewed, features used, Reports generated, timestamps, and interactions with the Services.
- Device and connection data: IP address, browser type, operating system, device identifiers, and referring URLs.
- Cookies and similar technologies: we use cookies and similar technologies for authentication, preferences, analytics, and security. You can control cookies through your browser settings; disabling cookies may limit some functionality.
1.3 Information From Third Party Sources
To generate Reports, we obtain property data from third party sources, including public records providers, listing data providers, and property imagery services. This data relates to real property rather than to individuals, but may incidentally include information associated with a property, such as prior sale records.
2. How We Use Information
We use the information we collect to:
- Provide, operate, and maintain the Services, including generating and delivering Reports;
- Process payments and transactions;
- Create and manage your account;
- Communicate with you, including service notifications, support responses, and, with your consent where required, marketing communications such as our email list (you can unsubscribe at any time using the link in any marketing email);
- Improve and develop the Services, including improving valuation methodology, accuracy, coverage, and product features;
- Monitor, secure, and debug the Services, including detecting fraud, abuse, and unauthorized access;
- Enforce our Terms of Service and other policies;
- Comply with legal obligations.
3. Artificial Intelligence Processing
Reports are generated with the assistance of artificial intelligence technologies, including AI services provided by third party vendors. Property information you submit is processed by these services to produce your Report. Our AI vendors are engaged as service providers and are contractually restricted from using data we send them for purposes other than providing services to us. Realsy does not sell information processed through these systems.
4. How We Share Information
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes. We share information only as follows:
4.1 Service Providers. We share information with vendors that perform services on our behalf, including payment processing, email and marketing platform services, AI processing, property data and imagery services, cloud hosting and infrastructure, database services, and analytics. These providers are permitted to use the information only to perform services for us.
4.2 Legal Requirements. We may disclose information if required to do so by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a lawful government request.
4.3 Business Transfers. If Realsy is involved in a merger, acquisition, financing, reorganization, or sale of all or a portion of its assets, information may be transferred as part of that transaction. We will provide notice of any change in ownership or in the use of your personal information as required by law.
4.4 With Your Direction. We share information when you direct us to, such as when you share a Report with another party.
4.5 Aggregated and De-Identified Data. We may use and share aggregated or de-identified information that cannot reasonably be used to identify you, including for analytics, methodology research, and product development.
5. Data Retention
We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Account information is retained while your account is active and for a reasonable period afterward. Report and property data may be retained longer for methodology improvement, quality assurance, and record keeping, in identifiable form only as long as necessary for those purposes.
6. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as required by applicable law.
7. Your Choices
- Marketing emails: unsubscribe at any time via the link in any marketing email. We use double opt-in for our mailing list.
- Account information: you may update your account information by contacting support@realsy.com.
- Cookies: manage through your browser settings.
8. US State Privacy Rights
Depending on your state of residence, you may have rights under state privacy laws, including the California Consumer Privacy Act as amended (CCPA/CPRA) and similar laws in other states such as Colorado, Connecticut, Texas, Utah, and Virginia. These rights may include:
- Right to know/access: request a copy of the personal information we hold about you and information about how it is collected, used, and shared;
- Right to correct: request correction of inaccurate personal information;
- Right to delete: request deletion of your personal information, subject to legal exceptions;
- Right to opt out of sale or sharing: Realsy does not sell personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of;
- Right to non-discrimination: we will not discriminate against you for exercising your privacy rights.
To exercise any of these rights, email support@realsy.com with the subject line “Privacy Request.” We will verify your identity before fulfilling a request, typically by confirming control of the email address associated with your account, and will respond within the timeframe required by applicable law. You may designate an authorized agent to submit requests on your behalf; we may require proof of authorization.
Categories disclosure (California). In the preceding 12 months, we have collected the following categories of personal information as described in Section 1: identifiers; commercial information; internet or other electronic network activity; professional information; and geolocation inferred from IP address. We collect these categories from the sources, for the purposes, and with the disclosures described in Sections 1 through 4. We do not collect sensitive personal information as defined by the CCPA, and we do not knowingly process personal information of consumers under 18.
9. Children's Privacy
The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact support@realsy.com and we will delete it.
10. Do Not Track
Some browsers transmit “Do Not Track” signals. Because there is no industry standard for responding to these signals, the Services do not currently respond to them.
11. Users Outside the United States
The Services are operated from the United States and are intended for users located in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be posted on the Site with a revised “Last Updated” date, and material changes will be communicated by reasonable means, such as email or a notice within the Services. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.
